B1. Acceptance of Terms
By registering for or using the Tlatsa Customer App, Tlatsa Driver App, Tlatsa Station Portal, or related Services, you agree to be bound by these Terms of Service and the Privacy Policy. If you do not agree, you may not use the Services.
B2. Description of the Service
Tlatsa operates a technology marketplace connecting: (a) customers who wish to order fuel for delivery or to view fuel-station information; (b) independently licensed and compliant delivery partners who fulfil fuel-delivery orders; and (c) participating fuel stations who publish price, availability, and queue information.
Tlatsa is a technology intermediary. Tlatsa does not itself sell, own, store, or physically transport fuel. Delivery partners are independent operators responsible for complying with all applicable petroleum-transportation, road-transport, and safety requirements. Fuel stations are independently responsible for the fuel and information they provide.
B3. Eligibility
You must be at least 18 years old and capable of forming a binding contract under Botswana law to use the Services.
Drivers must hold all licences, permits, and documentation required to lawfully transport and deliver fuel, and must keep these current and valid at all times while active on the platform.
Fuel stations must have the authority to publish pricing and availability information on behalf of the station.
B4. Account Registration & Security
You must provide accurate, current, and complete information when registering, including phone-number verification via OTP.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
You must notify Tlatsa promptly of any unauthorised use of your account.
B5. Ordering, Pricing & Payment
Fuel prices displayed reflect information provided by participating stations and may change between order placement and delivery due to market conditions; the price shown at order confirmation is the price charged for that order.
Delivery fees are calculated and displayed before you confirm an order.
Payment is processed through a licensed third-party payment provider. Tlatsa does not store your full card or bank account details.
Orders are only dispatched for driver matching once payment has been confirmed by the payment provider.
You agree to pay all charges associated with orders placed under your account.
B6. Delivery Partners (Drivers)
Delivery partners are independent operators, not employees or agents of Tlatsa. Tlatsa facilitates the connection between customers and delivery partners and monitors delivery-partner compliance documentation, but is not itself the transporter of fuel. Delivery partners are solely responsible for the safe, lawful, and compliant transport and delivery of fuel, including compliance with all applicable BERA, DRTS, hazardous-goods, fire-safety, and insurance requirements.
B7. Fuel Stations
Participating fuel stations are responsible for the accuracy of the price, availability, and queue information they publish through the Station Portal. Tlatsa relies on this information to inform customers but does not independently verify real-time fuel quality or station-level accuracy at all times.
B8. Cancellations & Refunds
Customers may cancel an order prior to driver arrival, subject to any applicable cancellation fee disclosed at the time of cancellation.
Refunds for failed, incomplete, or disputed deliveries will be assessed by Tlatsa on a case-by-case basis and processed through the original payment method via our payment provider.
Repeated unjustified cancellations may result in restrictions on your account.
B9. User Conduct
You agree not to:
Provide false or misleading information, including false vehicle, identity, or compliance information.
Use the Services for any unlawful purpose, including circumventing petroleum-transport or safety regulations.
Harass, threaten, or endanger any driver, customer, or station staff.
Interfere with or disrupt the integrity or performance of the Services.
Attempt to gain unauthorised access to the Services or other users’ accounts or data.
B10. Driver-Specific Terms
Drivers must maintain valid, verified compliance documentation at all times; the platform will automatically restrict job offers where any required document is missing, unverified, or expired.
Drivers must confirm customer identity, vehicle, and fuel type/quantity before dispensing fuel, and must follow all safety procedures required by their own operating licence and applicable law.
Drivers are responsible for their own tax, insurance, and regulatory obligations as independent operators.
B11. Intellectual Property
The Tlatsa name, logo, brand assets, application software, and platform technology are the property of Tlatsa Technologies (Pty) Ltd and may not be copied, modified, or used without prior written consent. Content you submit (such as ratings or support messages) remains yours, but you grant Tlatsa a licence to use it to operate and improve the Services.
B12. Disclaimers & Limitation of Liability
The Services are provided “as is.” Tlatsa does not guarantee uninterrupted or error-free operation of the Services, the accuracy of station-reported price/availability/queue data at every moment, or specific delivery times.
Because delivery partners are independent operators responsible for the physical handling and transport of fuel, Tlatsa’s liability for any loss, damage, injury, or incident arising from the physical delivery of fuel is limited to the fullest extent permitted by Botswana law, without prejudice to any statutory consumer-protection rights that cannot be excluded.
To the fullest extent permitted by law, Tlatsa’s total liability arising from use of the Services shall not exceed the amount you paid for the order giving rise to the claim.
B13. Indemnification
You agree to indemnify and hold Tlatsa harmless from claims, damages, or expenses arising from your breach of these Terms, your misuse of the Services, or (for drivers) your failure to maintain required licences, permits, or safety compliance.
B14. Suspension & Termination
Tlatsa may suspend or terminate your account for breach of these Terms, safety concerns, non-compliance with required documentation (for drivers), fraudulent activity, or as required by law. You may close your account at any time through Support.
B15. Dispute Resolution & Governing Law
These Terms are governed by the laws of the Republic of Botswana. Disputes arising from use of the Services shall first be addressed through Tlatsa’s Support/complaints process; unresolved disputes shall be subject to the jurisdiction of the courts of Botswana, without prejudice to any statutory right to an alternative forum.
B16. Changes to These Terms
Tlatsa may update these Terms from time to time. Continued use of the Services after an update constitutes acceptance of the revised Terms. Material changes will be notified in advance where reasonably possible.
